This Privacy Policy (“Policy”) explains how Burgan Real Estate, Ltd, Inc., an Ohio corporation doing business as Burgan Property Management (“we,” “us,” or “our”), collects, protects, and uses the personally identifiable information (“Personal Information”) you (“User,” “you,” or “your”) may provide through BurganPropertyManagement.com and its related pages, forms, and services (collectively, the “Website” or “Services”). It also describes the choices available to you and how you can access and update your information.
“We,” “us,” and “our” include Burgan Real Estate, Ltd, Inc. and its affiliates, subsidiaries, successors, and assigns. They do not include our service providers, contractors, or vendors, whose handling of information on our behalf is described under “Disclosure of Personal Information.” The Website includes our public pages, online forms, accessibility and security tools, analytics, embedded maps, and links to services offered by third parties. This Policy should be read together with our cookie notice, consent banner, our Terms and Conditions, and any feature-specific notices that apply.
This Policy does not apply to the practices of companies we do not own or control, or to individuals we do not employ or manage. That includes We Insure, which provides renter’s insurance and collects information on its own platform under its own privacy policy. Rental applications, the resident portal, owner logins, and online payments are hosted by Buildium. Information you submit through Buildium is processed by Buildium on our behalf and is also subject to Buildium’s privacy policy. We receive and use that information to process rental applications, manage leases and properties, and serve property owners, as described in the application materials, your lease or management agreement, and applicable law, including the Fair Credit Reporting Act. See “Links to Other Websites and Third-Party Services” below.
We receive and store information you knowingly provide when you submit one of our online forms, such as a contact, property-owner, or service inquiry form. This information may include your name, email address, phone number, property address, the message you write, and any other details you choose to share. Submissions are stored in the Website’s database and emailed to our team. Our forms (built with Gravity Forms) also record your IP address by default.
You can choose not to provide certain information, but then we may not be able to respond to your request. If you are unsure what is required, please contact us. Depending on how you interact with the Website, we may collect the following categories of Personal Information:

Those are collected through Buildium’s platform on our behalf (see above and below). Please do not include sensitive information in our web forms unless a form expressly asks for it and you have authority to provide it. If you submit information about another person, you represent that you have authority to do so and have given any legally required notices and obtained any legally required consents.
When you visit the Website, our servers automatically record information your browser sends, such as your IP address, browser type and version, operating system, language preferences, the page you visited before ours, the pages you view, time spent on those pages, search terms entered on the Website, and access dates and times. We also collect information through cookies, pixels, tags, local storage, server logs, and similar technologies (“Tracking Technologies”). Depending on how these tools are configured and applicable law, some data historically described as non-personal information may be treated as Personal Information.
Tools used on this Website. As of the “last updated” date below, the Website uses the following third-party tools. Each may set its own cookies or collect its own data under its own privacy policy.
The tools we use may change over time. We will update this Policy to reflect material changes in our practices.
Some state privacy laws apply only to businesses that meet revenue or data-volume thresholds. Where such a law applies to us, some disclosures to analytics providers may be considered a “sale,” “sharing,” or targeted advertising under certain state privacy laws. Where required, we provide notice and a way to opt out, including recognition of legally required opt-out preference signals such as Global Privacy Control.
We may use the information we collect to personalize your experience; improve the Website; respond to your inquiries and emails; provide, operate, maintain, secure, debug, and measure the Website and Services; communicate with you about rental, owner, or property management questions; maintain records; prevent fraud, spam, misuse, and security incidents; conduct analytics and market research; comply with legal, contractual, insurance, professional, and regulatory obligations; enforce our rights and agreements; and for any other purpose disclosed when information is collected or with your consent.
We process Personal Information for the purposes described in this Policy, including with your consent, to respond to your requests or take steps before entering into an agreement with you, to comply with legal obligations, and for our legitimate business interests.
We are based in the United States, and the Website is intended for users located in the United States and is not directed to individuals in the European Economic Area, the United Kingdom, or other jurisdictions outside the United States. If you access the Website from outside the United States, your information may be processed in the United States and other jurisdictions that may not offer the same level of data protection as yours. Where required, we use appropriate safeguards for cross-border transfers, such as contractual terms or other lawful mechanisms. You may contact us for more information about the legal basis for any such transfer.
We may disclose Personal Information to affiliates, subsidiaries, and related companies; service providers, contractors, and vendors (including website hosting, cloud, security, analytics, forms, and communications providers); cookie and consent-management providers; owners of properties we manage, and contractors performing work at a property, as needed to respond to your inquiry or request; professional advisors, insurers, and auditors; regulators, courts, law enforcement, and government authorities; purchasers or parties to a business transaction; and other parties with your consent or at your direction. Where required by law, service providers may process information only for authorized purposes and subject to appropriate contractual restrictions.
We may also disclose information to comply with law, legal process, subpoenas, court orders, or regulatory requests; to meet professional obligations or insurance requirements; to respond to security incidents or prevent fraud; to protect our rights; in connection with a business transaction; or to enforce our terms and policies. We may disclose de-identified, aggregated, or otherwise non-identifiable information for any lawful purpose, subject to applicable law.
The Website links to websites and services we do not own or control. We are not responsible for their privacy practices, and we encourage you to read the privacy policy of each site you visit.
Our Website may also link to social-media pages and other third-party platforms. Their practices are governed by their own policies and terms.
The Website uses cookies to help personalize your online experience. A cookie is a text file placed on your device by a web page server. Cookies cannot run programs or deliver viruses, and can only be read by a web server in the domain that issued them. We use cookies to collect, store, and track information for statistical purposes and to operate the Website. Depending on the page, we may use essential cookies, preference cookies, analytics cookies (Google Analytics), security cookies (Cloudflare and Google reCAPTCHA), accessibility cookies (accessiBe), and cookies from embedded content such as Google Maps.
You can accept or decline cookies through our cookie banner, which is provided by Osano, or by changing your browser settings. If you decline cookies, you may not be able to fully experience the Website’s features. Cookie choices may be browser- and device-specific and may not affect information processed in other contexts. Where required by law, we will honor Global Privacy Control and similar opt-out preference signals.
We do not sell Personal Information for money. As of the “last updated” date below, we do not run advertising pixels, retargeting, or conversion tracking on this Website. However, certain disclosures to analytics providers, such as Google Analytics, may be considered a “sale” or “sharing” under some state privacy laws. Where required, you may opt out through our cookie banner or preference tools, or by contacting us using the information below. Where required by law, we will recognize Global Privacy Control or another legally required opt-out preference signal as an opt-out request for the browser or device that sends it.
Some browsers send “Do Not Track” signals. Because there is no common industry standard for these signals, the Website does not respond to them, except that we honor Global Privacy Control as described above where required by law. Third parties whose tools appear on the Website, including Google (Analytics, reCAPTCHA, and Maps), may collect information about your online activities over time and across different websites.
Depending on where you live and whether a privacy law applies to us, you may have certain rights regarding information we process, which may include the right to: (i) withdraw consent you previously gave; (ii) object to processing carried out on a legal basis other than consent; (iii) learn whether we process your information, obtain disclosure about that processing, and receive a copy; (iv) verify the accuracy of your information and ask for it to be updated or corrected; (v) in certain circumstances, restrict processing, in which case we will only store your information; (vi) in certain circumstances, obtain erasure of your Personal Information; and (vii) receive your information in a structured, commonly used, machine-readable format and, if technically feasible, have it transmitted to another controller.
Depending on your state or country of residence, you may have additional rights to know, access, confirm processing, obtain a portable copy, correct, delete, opt out of sale, sharing, targeted advertising, or certain profiling, limit the use of sensitive personal information where applicable, appeal a denial of a request, and not be discriminated against for exercising privacy rights.
To make a request, contact us by email at BurganRE@burganrealestate.com, by telephone at our main office at 330-783-0055, or by mail at 5335 Market St, Boardman, OH 44512. Requests are free of charge, and we will address them as early as possible and within the time required by law. We may ask you to verify your identity or authority. Authorized agents may submit requests where permitted by law, but we may require proof of authorization and ask you to verify your identity directly. If we deny a request and applicable law gives you an appeal right, you may appeal by contacting us and stating “Privacy Appeal”.
If your request concerns information you provided to We Insure, please contact We Insure directly. For rental application, resident, or owner information maintained in Buildium on our behalf, please contact us.
We ask that you not provide sensitive personal information through the Website unless a form specifically requests it. Sensitive personal information may include precise geolocation, government identifiers, account credentials, financial account information, racial or ethnic origin, religious beliefs, health information, biometric data, union membership, citizenship or immigration status, the contents of private communications, and information about children. We process any sensitive personal information we receive only as reasonably necessary for disclosed purposes, security, legal obligations, or as otherwise permitted by law.
We do not knowingly collect Personal Information from children under 13. If you are under 13, please do not submit any Personal Information through the Website. We encourage parents and guardians to monitor their children’s internet use and to instruct them never to provide Personal Information through the Website without permission. If you believe a child under 13 has provided Personal Information to us, please contact us and we will take appropriate steps to delete it.
We use the contact information you submit through our forms to respond to your inquiry and to send related service, administrative, legal, security, or billing messages. If you receive marketing emails or texts from us, you can opt out of emails by using the unsubscribe link or contacting us, and out of texts by replying STOP. You may also revoke consent to calls or texts by any other reasonable means, including by contacting us. We do not sell, rent, or share your mobile phone number or text-messaging consent with third parties for their own marketing purposes. Where required, we obtain consent before sending marketing texts or emails. Consent to marketing is not a condition of receiving our services. We may still send you service-related messages.
We take reasonable measures designed to protect information you provide from unauthorized access, use, or disclosure, and we use Cloudflare for server-level security. We maintain reasonable administrative, technical, and physical safeguards to protect Personal Information in our custody. However, no transmission over the internet or a wireless network can be guaranteed to be secure. You acknowledge that (i) the internet has security and privacy limitations beyond our control; (ii) the security, integrity, and privacy of information exchanged between you and the Website cannot be guaranteed; and (iii) such information may be viewed or tampered with in transit by a third party despite reasonable precautions. You are responsible for using secure devices, protecting your passwords and account credentials, using secure channels for sensitive information, and notifying us promptly if you believe your interaction with us is no longer secure.
We keep Personal Information for as long as reasonably necessary to fulfill the purposes in this Policy, including responding to inquiries, maintaining records, complying with legal obligations, resolving disputes, supporting audits, enforcing agreements, preventing fraud, preserving security, maintaining backups, and satisfying tax, accounting, insurance, professional, and regulatory requirements. Retention periods vary by the type of information, context, and legal and business needs.
If we learn of a security incident affecting the Website or Personal Information in our custody, we may take measures we consider appropriate, including investigation, remediation, reporting, and cooperation with law enforcement. If an incident requires notice under Ohio Revised Code 1349.19 or another applicable data-breach law, we will notify affected individuals, and any government agency where required, within the time and by the methods that law requires. We may require service providers to notify us of suspected or actual security incidents or unauthorized access involving information processed on our behalf.
We may modify this Policy at any time, effective when an updated version is posted on the Website. When we do, we will revise the “last updated” date at the bottom of this page. Continued use of the Website after a change constitutes your acceptance of it. We will not use Personal Information collected before a material change in a materially different way without your consent where required by law. If we make material changes, we will give notice as required by law, which may include posting an updated Policy, a website notice, an email, or a request for consent where required.
By using the Website, you acknowledge that you have read this Policy. This Policy describes our practices; it is not a contract and does not create contractual rights or obligations beyond those imposed by applicable law. Your use of the Website is also governed by our Terms and Conditions, including their disclaimers, limitation of liability, and dispute-resolution provisions. Where consent is required by law, we will request it through an appropriate mechanism.
If you have questions about this Policy, please contact us by email at BurganRE@burganrealestate.com, by telephone at our main office at 330-783-0055, or by mail at Burgan Real Estate, Ltd, Inc., Attn: Privacy, 5335 Market St, Boardman, OH 44512.
